The proposal for the reform of shared custody

The implications of the reform

The proposed reform is not only a legal issue, but also touches on social and psychological aspects. Domestic violence has devastating effects on children, who can suffer long-term trauma. Entrusting children to the abused parent means recognizing the seriousness of the situation and acting for their well-being. In addition, the law could incentivize victims to report abuse, knowing that the legal system supports and protects them.

The current context and the challenges to be faced

Currently, the law on shared custody does not provide specific measures for cases of domestic violence, often leaving children exposed to dangerous contact with the violent parent. This legislative gap has led to unacceptable situations, where children's rights have not been adequately protected. Cesa's proposal comes in a context of growing attention to child protection and the fight against gender-based violence, but it will face significant challenges to become a reality.
