The Yara Gambirasio case has returned to the spotlight following the television appearance of Nicolas Bossetti, son of Massimo Bossetti, who was sentenced to life in prison for the murder of the thirteen-year-old girl from Brembate. During an episode of "Ore 14 di sera" on Rai2, the young man called the case "a Garlasco 2" and maintained that "we've never seen a case with so many errors."
The defense's requests and the Assize Court's response
Bossetti's lawyers, Claudio Salvagni and Paolo Camporini, filed a request with the Bergamo Court of Assizes for new technical and scientific tests on the artifacts still preserved. The reason was clear: to reanalyze the DNA found on Yara's jacket to determine whether the match with Unknown Person 1—currently identified as Massimo Bossetti—was truly certain.
Reasons for the judicial decision
The twelve-page ruling rejected the appeal, finding that the request lacked "specificity" and "novelty." The judges emphasized that the requested evidence had already been thoroughly examined during the trial, and that any reassessment would not alter the overall framework that led to the conviction.
Technical details on the genetic profile
According to the court document, the profile of Unknown Person 1 was not extracted solely from trace 31G20, the blood found on Yara's underwear. Fifty-two samples were taken from the underwear, sixteen of which matched Bossetti's profile. Additionally, twelve samples were taken from the leggings, two of which matched the trace of Unknown Person 1.
The court held that there was no doubt about the presence of Bossetti's DNA on the victim's underwear and that the alleged semen sample on the jacket had not been attributed to the convicted man, which is why the defense could no longer advance any claims in this regard.
Reactions from lawyers and family members
Lawyer Massimo Salvagni called the decision an "impenetrable wall" hiding something and announced his intention to appeal to the Supreme Court and raise the issue with the competent prosecutor's office. "We will certainly appeal, because we will not allow the truth to remain buried," he stated.
For their part, the Gambirasio family's lawyers, Andrea Pezzotta and Enrico Pelillo, recalled their fears of a possible "Garlasco 2" and reaffirmed their determination to prevent it from happening. "The Court agreed; we hope the others will give in, but we fear the opposite," they concluded.
Meanwhile, Massimo Bossetti, present via live link from Bollate prison, silently observed the decision, while his son Nicolas reiterated his belief that his father is not guilty, adding: "If we had the opportunity to analyze that 'holy' DNA, the results would be different."
