The crime of violent participation in a demonstration has been introduced. The crackdown is part of the "Protest Decree," a set of measures introduced by the government to combat violence during demonstrations following the clashes in the streets in recent days.

With the new decree, Prime Minister Giorgia Meloni explained in a video posted on social media after the Cabinet approved it, "a new crime has been created: violent participation in a demonstration. This means: if during a march or demonstration you join a group of five or more people and start throwing stones, firecrackers, or sticks, endangering everyone's safety, you risk up to five years in prison and a fine of up to 20 euros."

“If you had your face covered,” the prime minister added, “or if you injured someone, the penalty increases, and the penalties for those who commit mass destruction also increase.”

In the second point of the decree, "we apply a simple principle: whoever breaks it pays, and if the person who breaks it is a minor, their parents pay." How does it work? If the damage is to a public property—a bus shelter, a traffic light, a van—the prefect sends the owner a payment order; if the damage is to a private individual—a shop window, a store, a car—the owner goes to the judge and obtains an immediately enforceable injunction.

We can oppose it, of course, but in the meantime the parents of that boy who enjoyed smashing everything will have to pay, and whoever suffered the damage will be able to recover everything, from that family's assets, even from any money the state may owe them", the prime minister continues.

Third: minors. Today, for a child between the ages of 14 and 18, the State must demonstrate every time that he or she was capable of understanding what he or she was doing.

We had already approved a law that overturns this principle: it is presumed that he was capable of understanding what he was doing unless proven otherwise. That law is in Parliament, but with today's decree it becomes effective immediately. And preventive detention, which until now only applied to adults, can now also be applied to minors," explains the Prime Minister.
