After requesting a damage assessment from the insurance company, the 58-year-old was denied compensation. The company justified the refusal by arguing that there was no third-party status between the injured party and the person responsible for the damage. The son then sued his father for compensation for the damages he had suffered. The father, in turn, sued the insurance company, challenging the failure to provide coverage under the policy.
The dispute focused on the validity and enforceability of the insurance coverage for the damage caused by the father to his son's home. Judge Giovanni Piccioli of the Court of Lucca found the 58-year-old responsible for the damage caused by the fire, considering the man's conduct to be significant, as he had left the property after lighting the stove and fireplace. The Court assessed the compensation at approximately €24, plus €5 for legal fees, but also confirmed and declared the enforceability of the insurance policy taken out by the father. The sum must therefore be paid by the insurance company, which is required to cover the financial consequences of the accident. This brings to an end, at least in terms of liability and insurance coverage as established in court, a case in which a domestic intervention turned into a dispute between family members.
